The terms of service described below define the basic rules for use of 3and1.com`s systems and services. These terms can be changed or modified at any time by 3and1.com.

Basic account information:

Your first month’s fees are payable prior to account activation. There after, you will be billed monthly, on the sign up date of your service activation. Advanced payments will be accepted. Cancellations will be processed only at the end of your billing cycle. We accept checks, money orders, and cash as payment. Invoices will be sent via US Mail to the address entered during the registration process.

Services Provided:

3and1.com provides access to the Internet along with other related services to its subscribers. We do not and will not monitor information in content, quality, or accuracy, which may be available on our systems or on the Internet. Customers under the age of 18 must have parental or legal guardianship approval. 3and1.com is not responsible for any minor viewing adult material. Subscriber is responsible for installing and configuring any software that will be used in conjunction with 3and1.com`s systems. The subscriber is responsible for providing all computer equipment, modems, telephone lines, and telephone services necessary to access 3and1.com`s services. 3and1.com will not be responsible for any long distance telephone charges incurred by the customer if the customer is calling from outside of 3and1.com`s local calling area. 3and1.com reserves the right to perform maintenance procedures on its systems, without prior notice, generally between the hours of 3:00AM – 5:00AM. We will, however, attempt to notify our customers via email if at all possible. Service is provided for one dial-in login per account at any given time

Lawful Use:

3and1.com`s systems may not be used in any manner that would violate or infringe upon any of the following: federal or state laws, copyrights, right of publicity, trademarks, trade secrets, right of privacy or any other right of any person or entity. Our systems and services may not be used to transport or store any material, which is obscene, libelous or inflammatory. 3and1.com exercises no control whatsoever over the content of the information passing through its systems or stored on its systems. 3and1.com provides access to Shareware/Freeware software. 3and1.com is in no way responsible for the sale, distribution, or licensing of this software and accepts no liability of any kind with respect to any damages the use of this software may cause. The customer accepts all risk with respect to the use of this software.

Unacceptable Conduct:

Subscribers may not: violate the personal rights of other individuals in any Internet based forum

Post offensive messages on 3and1.com local newsgroup.

Use our services for sending unsolicited email (SPAM)

Post offensive material on personal websites.

Terms of Payment:

Monthly fees are net 10 days. An account will become delinquent if payment has not been received.  Delinquent accounts are subject to immediate termination and collection proceedings. In the case of termination by 3and1.com or cancellation by the customer, we may remove any and all information, including but not limited to, files and data, from our systems, and will not be responsible for preserving such data for the customer. The customer shall make no rights or claims to this information upon termination or cancellation.

Terms of Liability/Warranty:

3and1.com makes no warranties of any kind, whether expressed or implied, for the service it is providing. Use of our systems, services, and the Internet in general is at the customer’s own risk. Our systems and services are provided without warranty of any kind on an "as is" and "as available" basis. 3and1.com will not be responsible for any damage you suffer from use of its service including, but not limited to, loss of data, delays, misdeliveries or service interruption caused by 3and1.com. 3and1.com in no case shall be liable for any damages including, and without limitation, the loss of profits.
